James Kotecki points out that most of the presidential campaigns are violating copyright when they put clips of their interviews from cable and network shows up on YouTube — and he hopes that this forces them to reexamine copyright laws. He also likes that the networks are setting a precedent in not going after the campaigns’ useage. I’m not so sure it’s a violation but a defensible use of fair comment but I agree with James in any case.

Thanks for posting this - is there a definitive answer out there on whether it’s fair use?
I based my assumption that it’s not on two factors:
1) The networks having to explicitly make their debate footage available to bloggers - implying that it otherwise wouldn’t be.
2) A network news producer once told me “You didn’t hear this from me, but you should upload your appearances on our channel to YouTube.” She was implying, I thought, that even if I were just taking a clip of my own interview, I would be doing something that, in the very least, CNN didn’t like.
So, I have my hunches but no clear answer.
